Police: 4th OWI in 5 Years for Racine Man

A Racine man remains in the Racine County Jail on a 4th OWI charge in 5 years. His initial appearance was delayed a day so the court could have a Spanish interpreter present.

A 28-year-old Racine man is facing his fourth operating while intoxicated charge after Caledonia police stopped him for not having working taillights.

Leonel Lozano-Servin will be formally charged Tuesday in Racine County Circuit Court with one count each of felony operating a vehicle while intoxicated, misdemeanor obstructing an officer and misdemeanor operating while revoked, OWI related. If convicted, he faces up to seven years, nine months in jail and/or up to $22,500 in fines.

Lozano-Servin appeared in court Monday for his initial appearance, but because he required a Spanish interpreter, his initial appearance was rescheduled for Tuesday.

According to the criminal complaint, Caledonia police on Saturday observed a vehicle at 3-Mile and Coachlight Drive without working taillights. Officers initiated a traffic stop, but the driver did not fully pull off the road and instead stopped in the westbound lane.

Police say the driver - later identified as Lozano-Servin -Β at first gave them a different name and birthdate than officers identified. He also said he didn't know his address and didn't have any ID on him but he had a phone number police could call. Officers say Lozano-Servin also told them he was just trying to get home after having some beers with friends.

Because they could smell intoxicants coming off the defendant and his eyes were red, watery and glassy, police had him step out of the car. Officers advised Lozano-Servin that the name and date-of-birth he gave them came back as invalid. At this point, the complaint reads, the defendant got upset and told police to just "take him away."

Three empty beer cars were found on the floor of the car, and police say Lozano-Servin consented to a legal blood draw at Wheaton Franciscan St. Mary's.

Lozano-Servin's initial appearane is at 1:30 p.m. Tuesday.
