Bret Rossbach, 52, of Caledonia, was charged with drunken driving (5th offense) Thursday by the Racine County District Attorney’s office.

If convicted, Rossbach faces up to six years in prison and fines up to $10,000.

According to a report by the Caledonia Police Department, Rossbach had just left a tavern and allegedly drove recklessly at 3:44 p.m. on Six Mile Road at State Highway 31.

A witness told police she had to brake several times so she didn’t hit Rossbach’s car with her car. This happened two or three more times and Rossbach gave her the middle finger.   At an intersection, Rossbach turned on his right turn signal and the woman passed Rossbach, according to the report.

Rossbach continued to follow the woman. However, Rossbach was now two cars behind her and he eventually passed the other car between them. At this point, Rossbach started tailgating the woman, waived his arms around and pointed at her. Afraid of Rossbach, she called 911.

During the traffic stop, police gave Rossbach a field sobriety test. After having failed the test, police gave him a Breathalyzer test, which measures a person’s blood-alcohol content (BAC). Rossbach’s BAC level was .112, which exceeded the .08 legal limit. Rossbach was arrested for a felony count of drunken driving (5th offense) and taken to the Racine County Jail.

His bail was set today at $2,000. A preliminary hearing has been set for 9 a.m. April 28 in Racine County Felony Court Judge Eugene Gasiorkiewicz’s courtoom.
