Caledonia Man, Who Allegedly Drove Drunk, Had Loaded Gun In His Car

He had a license to carry a concealed weapon, which would have been fine, if officers wouldn't have smelled alcohol on him and was driving recklessly.

A local man suspected of driving drunk and allegedly having a loaded gun concealed under the front seat of his car was charged by the Racine County District Attorney’s office yesterday, Feb. 9, 2012.

Scott Sebastian, 53, of Caledonia, was arrested for allegedly being armed while intoxicated, and cited for suspicion of drunk driving and following a vehicle too closely at 10:53 p.m. Feb. 8, 2012 on Six Mile Road at County Trunk Highway H.

Sebastian, who owns restaurant in Caledonia, said he had a license to conceal carry a weapon.

“At this point, I’m only suspected of driving intoxicated,” Sebastian said. “They (the police) never asked me whether they could search my car.”

According to a report by the , a witness told police that Sebastian was allegedly driving his red Honda Civic “all over the road, and following closely to him varying it’s speed” on State Highway 38 and County Trunk H, according to a report by the Caledonia Police Department.

When Sebastian pulled over the car, he did so on the west side of the roadway. When the officer went to approach him, Sebastian pulled forward into a parking lot, backed up the car up and then pulled forward again while the officer demanded that he stop the car. Police suspected Sebastian of drinking because they smelled alcohol on him and when they asked him to do the field sobriety test, he refused.

Afterward, police searched Sebastian’s car looking for open intoxicants. They saw an empty pistol holster on the floor of the car, and then found a loaded 9 mm handgun underneath the seat. Sebastian has license to carry a concealed weapon, but Lt. Gary Larsen, of the Caledonia Police Department, said people who are intoxicated are prohibited from carrying firearms.

“If you are intoxicated, it doesn’t matter,” he said.

According to the report, Sebastian called one of the police officers “a rookie multiple times and was swearing and being belligerent about the arrest. Scott said the Caledonia Police Department was the Gestapo.”

Formal charges are pending with the results of Sebastian’s blood draw, which was taken at a hospital. The blood sample was sent to the state crime lab, which could take up to a month for the District Attorney’s Office to receive.
