Curt Johnson Trial: State Prosecutor Defends High Court Decision

A state prosecutor is supporting a Wisconsin Supreme Court decision that Curt Johnson's stepdaughter can testify against him in Johnson's sex assault case.

An article in the Journal Times of Racine cited a filing Monday by Assistant Attorney General Marguerite Moeller. Justices didn't agree on why the girl — who Johnson is accused of assaulting — could testify against Johnson without releasing her medical records. But Moeller said the decision didn't violate any rules.

Johnson's attorney filed a motion challenging the court's decision, but Moeller said the Supreme Court decision wasn't "cobbled together" and justices didn't pool their votes together, according to the story.
