According to the criminal complaint and testimony from Jonathan's mother, Lori Kwiatkowski, Jonathan died just after he, and his family, had a violent conflict with Forester-Hoare over Jonathan's driving. Forester-Hoare also punched Lori and Tim Kwiatkowski. This prompted Richard Chiapete, the prosecuting attorney in the case, to file two additional charges against Forester-Hoare for the alleged altercation.

Forester-Hoare already faced life in prison if he was found guilty on the homicide charge. If he's found guilty of the two additional charges, he faces an additional 35 years in prison.
