Judge Modifies Bail for Waukesha Man Charged with Child Porn

Richard Chavez, who is charged with 34 counts of possessing child pornography, can use computer to submit job applications while supervised.

A Waukesha County judge changed a bail provision for a 19-year-old Waukesha man to allow him to use a computer to apply for jobs.

Richard Chavez will be allowed to use the Internet to submit job applications while under supervision. Another person is to fill out and submit the applications for Chavez and Chavez is not to use or possess anything that can access the Internet, Judge William Domina ordered Monday morning.

Chavez’s bail was previously set at $5,000 in Chavez is schedule to return to court on Oct. 17.

According to the criminal complaint:

Waukesha detectives were contacted by the Wisconsin Department of Justice after it was confirmed Chavez was downloading files through a peer-to-peer network. The files downloaded were known as child pornography.

Police executed a search warrant on Oct. 27 and told Chavez that they believed either he or his father was using the computer to download the child pornography. Chavez told investigators that his father did not use the computer.

“I may have accidently downloaded some child pornography,” Chavez told investigators.

Chavez then told investigators he downloaded the files because he did not believe the titles of the videos and pictures that were online. Chavez said that there were no images of the videos he downloaded, so he had to download each file in order to view it.

Chavez said he downloaded about 50 to 60 videos and watched each file about three or four times. Chavez also told investigators he looked at the porn even though it made him sick to his stomach. He said he was not a predator and does not touch children.

“This makes me sick,” Chavez told investigators. “This isn’t me.”

So now we will imprison this 19 year old for life because of curiosity? He never touched a soul... What is this state coming to? This is just sad that this boy is going to pay for his natural male curiosity that every young man has. I remember from 6th grade health class that males don't reach maturity until AROUND 18 years, which puts this young man in that catagory... I am ashamed of our lawmakers and our justice system that perpetuate this widespread hysteria about the different varieties of sex offenders from your teenage romances that sext and Facebook to your porn addicts that clicked the wrong link, to your pedophiles that prey on the children close to them. But don't forget the falsely accused because 'the victim' was looking for something, whether that be attention, revenge or fear of some other repercussion. Then you have the situation like the couple in TX, where the mother just wanted to teach her daughter's boyfriend now son-in-law a lesson, causing a lifetime of persecution for her daughter and grandchildren for what she 'did' to her son-in-law.
