Man Charged in Sexual Assault of 12-Year-Old Muskego Girl

Girl had met several times with 20-year-old man she friended on Facebook; police were contacted by her father after seeing her leave with the man in his vehicle.

A 20-year-old Mukwonago man has been charged with 2nd degree sexual Assault of a child after admitting to police he had inappropriate contact with a 12-year-old girl.

The girl's father reported seeing her leave with the man, Zachary Franck, in his vehicle in front of their Muskego home, and called police but it was evidence seen on the girl's Facebook page that led to his identity.

Franck faces a possible $10,000 fine, 15 years in prison or both if the maximum sentence is imposed.

According to the criminal complaint:

Muskego Police were sent to the girl's home on Sept. 17 on the report from her father that she was seen leaving without permission with a man not known to the family.

He attempted to wave the vehicle down as it left the scene, according to the report. The girl was eventually dropped off in the neighborhood again, but when police attempted to question her, she "was uncooperative and not forthcoming."

An investigation revealed the man's name and phone number on messages on the girl's Facebook page, which also indicated that the two had met previously.

Upon questioning, Franck first denied any sexual contact, but then told police that he had groped the girl's breasts and touched her inappropriately on the 17th as well as during previous meetings. Franck also told police that the girl told him she was 16 years old and a sophomore in high school.

He will make his initial court appearance on Jan. 21

Heather AND Denise I have seen many preteen girls that look ,act and dress very seductivly in the malls ect. . Where have you both been ? Neither one of these young people are total victims.The girl was looking for a young mans attention and she lied about her age.The guy should have insisted in meeting her parents,but of course he was looking for a no frills encounter. Not at all unusuall for men these days, even for those three times this 20 yr olds age

I do have to agree that a girl can dress herself up to look much older then she is. Heck the police departments do this all the time to bust bars for serving underage people.

Bottom line is that the maturity between a 12-year-old and a 16-year-old (socially, even what they sound like) are different. That's what we're saying. Yes, 12 year olds can dress up and cake on the makeup, but in my view, they still look like 12 year olds with inappropriate clothing and make up on. I have a daughter and I know none of her friends looked the same between those two ages. And again...16 is STILL illegal.

948.09 was not changed and criminalizes sexual intercourse with a "child". 948.01 defines child as a person under 18.
