Baas told police that he drank three beers before leaving a tavern and driving home with Smith. Driving northbound, Smith “grabbed the wheel and jerked it to the right” and screamed, “watch out!” Jerking the truck back to the left, Baas told police “before he knew what was happening he hit something and slid through some yards.” The truck went into a ditch, through three yards, took a small tree down, and smashed into a red van and small trailer.
