Sturtevant Dad Gets Jail Time for Shaking Baby

Justin Gardner pleads guilty to felony child abuse charge for causing 7-month-old's brain to bleed.

A Sturtevant man who shook a 7-month-old baby so hard it caused the infant's brain to bleed has been sentenced to six months in jail.

Justin Gardner was charged in May with a felony count of child abuse after shaking the infant, who was taken to an Illinois hospital and diagnosed with two separate brain bleeds. He initially told police that the boy fell and hit himself on the carpeted floor.

Gardner pleaded no contest to the felony charge in June, and was sentenced Friday in Racine County Circuit Court the jail time and three years probation, according to online court records. However, Judge Charles Constantine ruled that Gardner only has to serve 90 days in jail and stayed the rest of the sentence.
