Recount Final Total: Lehman Wins By 819 Votes

The recount of the 21st District state Senate recall election ended Monday, however, Wanggaard is considering a legal challenge.

The recount in the 21st Senate District ended Monday, with Democrat John Lehman remaining the victor in the recall race against Republican Van Wanggaard.

The final vote total: Lehman 36,358; Wanggaard 35,539, a difference of 819 votes.

Racine County Clerk Wendy Christensen certified the results shortly before noon Monday and immediately sent the results to the state Government Accountability Board.

"It shows that we won the election and all of these allegations of voter irregularities are false and are really much ado about nothing," Lehman said. "The results from election night have been proven correct through tape and tally totals."

by 834 votes, in the only successful Democratic challenge in any of the recall elections held that day. Wanggaard asked for a recount on June 15, and the process started on June 20.

However, Wanggaard pointed to a number of voter irregularities, which he now he calls fraud.

“Anyone who argues that this recount was a waste of time, or that we do not need voter, ID, either wants to conceal these potential fraudulent activities or hasn’t been paying attention," Wanggaard said in statement. “The list of problems now includes missing pages in poll books, missing signatures, wrong voter numbers, wrong and unverified addresses and most shocking of all, unsealed and sealed and reopened ballot bags — all without explanation. None of these issues would have been discovered if not for the recount.”

Wanggaard's campaign has until July 10 to challenge the election results in court, according to the GAB. If he doesn't the state agency will certifiy the results, possibly on July 11.

Jonathan Strasburg, Wanggaard campaign attorney, confirmed that there has been no decision on whether or not the campaign will file any type of lawsuit regarding the issues in Racine with misplaced signatures and partially sealed ballot bags.

"We have five business days to make a decision," he said. "We want to let the dust settle on the last two weeks before we start talking about how to move forward."

Racine County Clerk Wendy Christensen said the recount process was long, and she is less than pleased with the condition of some of the materials that came in from the City of Racine.

"I believe I've done a lot when it comes to training poll workers, but it's clear that municipal clerks need to be sure they're hiring competent help," she said. "The way and the reflects poorly on the election process."

Christensen's deputy, Roseanne Kuemmel, agreed.

"These were not minor clerical errors," she said. "I'm appalled that they're being classified in that manner because what happened in the city make people lose their confidence in our election process."

Scott Kelly, a member of Wanggaard's campaign staff, said that if the recount results stand, Wanggaard will spend the next two years campaigning for a 2014 run to retake his seat.

Hey juk Read this: .....While Wanggaard was required to pay a $685 filing fee for the recount, the actual cost of the recount will be covered by county taxpayer dollars, Haas said. http://elections.wispolitics.com/2012/06/wanggaard-recount-to-start-on-wednesday.html .............. jukap29 3:25 pm on Monday, July 2, 2012 it isn't going to cost TAXPAYERS anything if the Wanggaard campaign is forced, by law, t0 pay for it out of pocket - which they will end up doing if they do in fact lose, do you not know rules morninmist? the only waste of taxpayer money IS the recall and the fraud perpetrated on the city of Racine by corrupt election rigging slime

Does their job include locking the poll doors, intimidation and manhandling?
Resistance is futile July 03, 2012 at 08:52 PM
Yes. Legal. Not like D'Abbraccio video taping voters without their knowledge.
James R Hoffa July 03, 2012 at 09:10 PM
@jukap29 - That is correct - we're still waiting for confirmation of recognition of the PAC by the GAB before we can start accepting donations into the account. When it has been confirmed that everything is legal, I will post a link so that those who wish to contribute can do so via Paypal. We've already had several commitments, but who really knows for sure until the money actually starts flowing in, right? In any case, at least we're trying - which is more than I can say for the left's attitude towards the public treasure.
jukap29 July 03, 2012 at 11:11 PM
funny, i'm not projecting, maybe you;re feeling guilty from cheating - have you ever done ANYTHING legitimate in your life? doubtful. I'll freely admit I'm not perfect, i'm flawed, but i ask forgiveness with a humble heart when I screw up - how bout you? and I live my life trying to do right by everyone, not just those i agree with, how bout you? and I don't lose my shiz over political BS that NONE of us can really affect directly unless we cheat (which I didn't do), how bout you?

Per GAB rules high school students were allowed to sign the recall petitions a long as they were 18 by the time of election day. ..................... ............ Stormy Weather 8:16 am on Tuesday, July 3, 2012 @walker - Did you even read the article about all the high school students signing the recall? I just wonder how many underage high school students across the state signed the recall and worse yet possibly voted?

SD21 Recount: Darlene Farr Testimony http://www.youtube.com/watch?v=MWmXeGiMqmI&feature=relmfu They were working on the floor. She believe the ballots were all in the bag. She believes the bags were completely stuffed. She doesn't know if there were other bags to use. She doesn't know who picked up the bags. She did not rebag or sign the bags.

SD21 Recount: Michael Clark Testimony http://www.youtube.com/watch?v=AfAQ-niEal4&feature=relmfu He did not re-seal the bag but was called in the next day to sign the re-sealed bag. Why would you sign something you didn't seal and did he sign the original bag he sealed?

SD21 Recount: Carol Mauer Testimony Pt. 1 http://www.youtube.com/watch?v=9WRaCAFft7U&feature=relmfu Can't seem to remember anything or get her stories straight. Again who signed the original seal bags and then the re-sealed bags. If there weren't enough signatures on the night of the election, who did they call in to sign the bags. The same people who sealed the bags or whoever they could get.

They require a photo ID in Mexico to vote so what is the complaint in Wisconsin about? So why doesn't Voces De La Frontera go protest in Mexico to repeal their photo ID. The only reason Wanggaard and the TeaGOP are contesting this election is to have an excuse and to yell about voter fraud once again!! Van lost. Get over it.

Hey folks of all stripes. Here is the truth. Working America ‏@WorkingAmerica A recount has confirmed what we already knew: anti-worker Republicans lost the majority in the #WI Senate on June 5th. #wiunion
morninmist July 05, 2012 at 04:18 PM
Golly gee mau So, the all so called fix for Fraud is the photo ID??

Sen Lehman will do what is right for ALL citizens of WI. He will work to ensure that many more are covered by health care. One Wisconsin Now ‏@onewisconsinnow #WalkerInc could save WI $3.7 billion ... but he'd have to drop opposition to helping people get health care http://goo.gl/9Wsg1 #wiunion http://www.washingtonpost.com/blogs/plum-line/post/gop-governors-may-be-shafting-their-own-states-and-constituents/2012/07/05/gJQAjiyXPW_blog.html Posted at 10:56 AM ET, 07/05/2012 GOP governors may be shafting their own states and constituents By Greg Sargent Republican governors who are threatening to opt out of the Medicaid expansion — which could deprive millions of insurance — have justified it by claiming that opting in could crush their state budgets. Their real motive may be ideological — they are striking a blow against Obama’s signature initiative and the welfare state in general — but the cost argument gives them a seemingly pragmatic rationale. But what if opting in to the Medicaid expansion could actually save states money over the long term? It’s very possible. The grounds for believing this can be found in an Urban Institute study that was conducted in 2011 but is newly relevant in light of the GOP governors’ threats.................

"Sen Lehman will do what is right for ALL citizens of WI." I almost lost my lunch reading this. I suppose you are talking about increasing auto insurance rates, or maybe it was his tax and spend policy (rubber stamp Jim Doyle?) NO, John Lehman will do what is right for himself. I do not want a draft dodger representing me. When the going gets tough, he runs.
Daniel Gregg July 05, 2012 at 06:28 PM
Show me a sore loser and I will show you a loser! the Democrats retook the Senate fair and square so stop your whining. The new Senate will get rid of the excesses of Scott "the Thug" Walker!
mau July 05, 2012 at 07:21 PM
And I hope the Republicans don't back down, like they usually do. They need to take a page from the screeching democrats rule book and whine and whine and whine until they get their way. They have to realize that no matter what they do the democrats and media will never approve of their actions.
mau July 05, 2012 at 07:28 PM
Golly geeeeee morninmist, hell no. This is just a start. Even with photo ID the cheating democrats will find a way around it. They need to clean up the whole voting process from making sure poll workers know and abide the rules (which ALL poll workers are sworn to do), get rid of same day registration, restrict in-person absentee voting and registrations to a controlled setting like a town or county building......
morninmist July 05, 2012 at 08:11 PM
yeah yeah mau We know all your talking points aimed at disenfranchising as many voters as possible. We know the TeaGOP's vile game.

Vos is an embarrassment to the people the WI. He should resign and go pop his corn!! Spud Lovr ‏@SpudLovr Rep. Robin Vos says voter fraud accounted for portion of Lehman’s victory in Senate recall = FALSE http://www.politifact.com/wisconsin/statements/2012/jul/06/robin-vos/wisconsin-rep-robin-vos-says-voter-fraud-accounted/ #wiunion ......Our rating Vos said voter fraud provided "a portion" of the difference in Wanggaard’s loss in a critical state Senate recall election. The Racine County Sheriff’s Department is investigating issues regarding election procedures and paperwork, but a top official told us they do not suspect fraud. What’s more, Vos acknowledges he has no direct evidence of fraud. Yet he said with "certainty" that there was fraud. Based on the information publicly available now, we rate his claim False.
James R Hoffa July 06, 2012 at 10:52 PM
@morninmist - The real shame of Wisconsin lies in the law makers that wore goofy solidarity shirts in the state house and started chanting 'shame' at their fellow legislators like a bunchy of lemmings instead of acting like adults and engaging in productive communications. But keep on denying reality - that's all you know how to do!
James R Hoffa July 06, 2012 at 10:55 PM
@morninmist - Please explain exactly how mau's suggestions would act to effectively disenfranchise any legitimate voters.
James R Hoffa July 06, 2012 at 10:57 PM
@morninmist - "Sen Lehman will do what is right for ALL citizens of WI. He will work to ensure that many more are covered by health care." And how will Lehman do this exactly and how will he pay for it?
James R Hoffa July 06, 2012 at 11:59 PM
The only reason fraud isn't being found is because no one is actively looking for it! All of the same day registrations that were done at those wards that realized a 100% or greater increase in the number of ballots cast vs the 2010 general election should be looked at and visits made to those addresses to see if those people actually live where they said they do. If this was done, then I'm sure that we'd see plenty of voter fraud coming out of the City of Racine. But until this is done, we'll never really know for sure, will we?
