DA's Office Won't be Seeking Charges Against Substitute Teacher

The woman, who had been a teacher for 40 years, was accused of choking a boy, but she won't be charged, police say.

A substitute teacher accused of choking a 9-year-old boy at Olympia Brown Elementary School on Jan. 7 will not be charged with a crime, according to police.

Caledonia Police referred the case to the Racine County District Attorney's Office for charges earlier this month. The woman had been a teacher in the school district for 40 years and is now substitute teacher.

Investigator Lisa Seils said the Racine County District Attorney's Office reviewed the case and decided not to pursue charges.

According to a report from the Caledonia Police Department, the boy told police he was playing a math game between 10 and 11:30 a.m. when a friend had won some candy, which the friend gave to the boy. When the boy went to throw away the candy wrapper at the front of the class, the teacher allegedly “took hold of his neck with both her hands and shouted, ‘Spit that candy out, spit that candy out!’”

Several students told administrators it looked like the teacher choked the boy. However, when police asked them to demonstrate what happened, they put their hands on their cheeks and said the boy's mouth was squeezed open.
