Nielsen To Seek Recount for Branch 10 Judicial Race

Attorney Mark Nielsen trails attorney Timothy Boyle by 57 votes after the Board of Canvass was conducted by the Racine County Clerk's office.

Editor's Note: Mark Nielsen was mistakenly identified as the incumbent judge for Branch 10. Judge Richard Kreul is the incumbent and is retiring. We have made the correction and regret the error. Mark Nielsen, attorney and an incumbent judge in the Racine Municipal Court, announced today that he will file a petition with the state Government Accountability Board asking for a recount for the results of the Branch 10 Circuit Court race. He ran against Burlington lawyer Timothy Boyle on April 3, and lost by 61 votes on election day. After Racine County canvassed its votes and included some outstanding absentee ballots in the count, Nielsen was still behind, but only by 57 votes. This recount isn't just about being disgruntle about the outcome of an election. It is all about the numbers. You must acknowledge that 57 votes out of over 32000 is a very small number. Les Aspin ran as a peace candidate in 1970, opposing the Vietnam War. In the Democratic primary he was opposed by Doug LaFollette, who was endorsed by the party. Branch 10 Judicial Race Headed for a Recount

Unofficial results on April 3 put Timothy Boyle ahead of incumbent Judge Mark Nielsen by just 61 votes. After Racine County's Board of Canvass, that lead narrowed to 57 votes, which means there will most likely be a recount.

*Updated at 4:25 pm April 12. Turns out those outstanding absentee ballots did make a difference in the race for Branch 10 of the Circuit Court. At the end of the night April 3, attorney Timothy Boyle led incumbent Judge Mark Nielsen by just 61 votes; 16,039 to 15,978. With over 400 absentee ballots yet to be counted - a new law gives absentee voters until 4 pm the Friday after the election to return their ballots - there was every possibility those votes could change the outcome of this election. Mount Pleasant Village Clerk/Treasurer Veronica Rudychev said she only received a handful of that village's 75 outstanding absentee ballots, and the votes were evenly split between Boyle and Nielsen.
