No New Charges for Curt Johnson

Judge Eugene Gasiorkiewicz has denied the state's motion to reconsider adding three felony counts of incest to the single felony count of repeated sexual assault of a same child that Johnson already faces.

Billionaire Curt Johnson will not face three addtional felony charges, and his April 23 trial date appears to be intact, according to a decision from Judge Eugene Gasiorkiewicz filed on Wednesday. Johnson was charged March 23, 2011 with a single count of repeated sexual assault of a same child. If the state had won its motion to reconsider, he would also face three additional felony counts of incest. But in his five-page opinion, Gasiorkiewicz said the state was well aware of the deadline he set and should have known last October that circumstances with the victim had changed. The District Attorney's Office first made the request Feb. 15, and Judge Eugene Gasiorkiewicz denied it because it missed the Jan. 23 deadline given during Johnson's…

Defense Attorney Will Try To Exclude Johnson's Therapist's Testimony

Billionaire Curtis Johnson is accused of repeated sexual assault of a child. His attorney's want to squelch testimony from his therapist, and have the victim's mental and medical records only seen by judge.

Samuel Curtis Johnson III is scheduled to be back in a Racine County Felony Court Friday where two motions will be decided. Judge Eugene A. Gasiorkiewicz will hear arguments about two motions dealing with what evidence will be heard in the sex assault case against Johnson. This spring, officials with the Racine County District Attorney’s Office accused Johnson of repeatedly sexually assaulting a child. Mark Richards, Johnson’s attorney, filed the motions, which asks only for the judge to see the victim’s medical and mental health records, and for the exclusion of Johnson’s therapist’s testimony. If convicted, Johnson could face up to 40 years in prison. The former head of Sturtevant-based Diversey, Johnson lives in Caledonia and is the …

Motions Will be Heard in September for Johnson Sex Assault Case

The defense is expected to file a number of evidentiary motions in the coming weeks.

Curt Johnson's lawyers today, June 17, appeared briefly in court for a pre-trial conference with the Racine County District Attorney to set up a briefing schedule leading to Sept. 23 when the court will hear motions from each side. Curt Johnson is the billionaire heir to the SC Johnson fortune. He did not appear in court. According the Racine County District Attorney Michael Nieskes, the defense will file a number of evidentiary motions. The prosecution will file responses and then the defense will file rebuttals. "We have a number of deadlines for when motions and responses are due over the course of the next couple of months," he said. Billionaire Johnson Buys Home in North Carolina; Pre-Trial Hearing Done Behind Closed Doors

The next court date is June 17, 2011.

The pre-trial conference before Court Commissioner Bonnie Nagy for Samuel Curtis Johnson III today, May 20, was done behind closed doors. Lawyers on both sides did not appear before Nagy. Attorneys for Johnson, Mark Richards and Michael Hart, met with Assistant District Attorney Robert Repischak, handed a paper to the clerk, and left the court room. "You can look on C-CAP," they answered when asked about the outcome of the conference. Records in the online case file indicate the next pre-trial conference is scheduled for June 17, 2011, again in Nagy's courtroom. A message was left for Repischak at the District Attorney's office regarding the hearing, and a call was placed as well to Richards' office to ask about the hearing and a report …
