Mistrial for School Aide Accused of Molesting Student

Judge orders mistrial after jury can't reach verdict on sexual assault charges against teachers aide.

Racine County Circuit Court Judge Charles Constantine declared a mistrial Friday in the case of Lewis Givens Jr.

Givens is accused of inappropriately touching a special education student at Olympia Brown Elementary in Caledonia. The alleged incidents took place from December 2010 to January 2011. The girl was 9 years old at the time and is now 11.

Once word of a hung jury was delivered to Constantine in a note, he declared a mistrial.

“We are at a severe standstill,” he is quoted in The Journal Times as reading from the note. “We are unsure how to proceed since we are less close to a verdict today than yesterday.”

The Racine County District Attorney's office will decide whether to retry the case.
