Sex Life is Off Limits When Molestation Trial Begins Monday,

Jurors will not hear testimony about whether or not accused child molester Lewis Givens had a healthy sex life with his wife when Givens' trial begins Monday.

He is accused of inappropriately touching a special education student between Dec. 2010 and Jan. 2011 at Olympia Brown Elementary School where he was educational aide. The girl was 9 at the time of the alleged incidents and is 11 years old now.

During a hearing Monday, The Journal Times reports, Defense Attorney Christie Hall tried to argue for witnesses who would attest to Givens being a truthful, religious man who would "never harm a child." Hall also wanted to question Givens' wife about their sex life because part of the law Givens is accused of breaking that says he did it for sexual gratification.

Racine County Circuit Court Judge Charles Constantine was not inclined to agree, ruling that witnesses could account for Givens' truthfulness but only after he takes the witness stand first. He flat out refused to consider Hall's argument when it came to the Givens' sex life.

"The fact that you had a healthy sexual relationship ... doesn’t necessarily mean you won’t commit a deviant act,” he is quoted as saying. "... it’s not happening. His sex life, no.”

Givens' will have a jury trial. It begins Monday.
